LOANER FURNITURE
At Demarchelier & Co., we are committed to ensuring an exceptional client experience. In certain situations—and solely at our discretion—we may provide temporary furniture or décor items (“Loaner Merchandise”) to a customer as a courtesy. This may occur when a customer’s purchased item is delayed, custom-made, or otherwise unavailable for immediate delivery.
By accepting any Loaner Merchandise, the customer agrees to the following terms and conditions, which form part of their overall agreement with Demarchelier & Co. and are incorporated by reference into our Terms & Conditions and related policies.
1. Ownership and Condition
All Loaner Merchandise remains the sole property of Demarchelier & Co. at all times.
Customers receive Loaner Merchandise on a temporary basis only and acquire no ownership, title, or other rights to the merchandise.
Loaner items are provided new or in showroom condition. Customers agree to use reasonable care and maintain the items in the same condition as received, normal wear and tear excepted.
2. Return of Loaner Merchandise
Loaner Merchandise must be returned to Demarchelier & Co. in its original condition when requested.
Unless otherwise arranged in writing, return will occur prior to or at the same time as the delivery of the customer’s purchased merchandise.
Demarchelier & Co. or its authorized delivery partners will coordinate collection. The customer agrees to grant reasonable access to retrieve the items upon request.
Failure to make Loaner Merchandise available for pickup as scheduled, or any refusal to return it, shall constitute non-return under this Policy.
3. Billing for Non-Returned or Damaged Loaner Merchandise
If any Loaner Merchandise is not returned when requested, is lost, or is returned in damaged condition beyond normal wear, the customer will be invoiced for the full current retail value of the merchandise, plus any applicable delivery, collection, or replacement costs.
Such invoice(s) are immediately due and payable in accordance with Demarchelier & Co.’s standard invoicing and payment policies.
Unpaid balances may incur late fees, interest, and collection costs, including reasonable attorney’s fees.
4. Customer Responsibility
The customer assumes full responsibility for the care, custody, and safekeeping of all Loaner Merchandise while in their possession, including protection from damage, theft, or loss.
Loaner items may not be altered, refinished, loaned to another party, or moved to another location without prior written consent from Demarchelier & Co.
5. No Warranty or Obligation
The provision of Loaner Merchandise is a courtesy accommodation and does not create any continuing obligation on the part of Demarchelier & Co.
We reserve the right to decline or terminate loaner arrangements at any time and to modify or discontinue this policy without notice.
6. Incorporation by Reference
This Loaner Furniture Policy forms part of and is subject to the Demarchelier & Co. Terms & Conditions, including without limitation the Payment Information Policy, Shipping & Return Policy, and Dispute Resolution provisions therein.
